Terms of Service

​Important: Please read these Terms of Service carefully before using the TAMI Guide application. By using the App you agree to be fully bound by these terms.

1. Definitions 

For the purposes of these Terms of Service:

  • "Company": Lighthouse Tech SA, registered in Switzerland

  • "App" or "Application": the TAMI Guide mobile application

  • "Service": all features and functionalities offered through the App

  • "User": any person who downloads, installs or uses the App

  • "TAMI Devices": the hardware devices manufactured by Lighthouse Tech SA that are compatible with the App

  • "Account": the personal account created by the User to access the Service

  • "Content": text, images, software, data and any other material present in the App

2. Acceptance of Terms

By using the App, the User declares to:

  • Have read and understood these Terms of Service

  • Fully accept these Terms

  • Accept the Company's Privacy Policy

  • Have the legal capacity to enter into a binding agreement

If you do not accept these terms, you are not authorised to use the App.

3. Age Requirements and Use by Minors 

​

3.1 General requirements

The App may be used by users of any age, however:

  • Users under 16 years of age must obtain the consent of a parent or legal guardian before creating an account

  • Users under 14 years of age may only use the App under the direct supervision of a parent or guardian

3.2 Parental/guardian responsibilities

Parents or legal guardians who allow minors to use the App:

  • Are responsible for supervising the minor's use of the App

  • Accept these Terms on behalf of the minor

  • Are responsible for any activity carried out by the minor through the App

  • Must ensure that the minor uses the App in a safe and appropriate manner

3.3 Device safety

TAMI Devices are designed to be safe. However, we recommend that minors use the devices under adult supervision, especially during initial setup

​

4. Description of the Service 

The TAMI Guide App provides the following features:

  • Connection and management of TAMI Devices via Bluetooth

  • Configuration of device settings

  • Device firmware updates

  • Device status monitoring and diagnostics

  • Receipt of notifications on updates and newsletters

  • Access to documentation and support

5. Registration and Account

​

5.1 Account creation

Some features of the App require the creation of an Account. The User agrees to:

  • Provide accurate, complete and up-to-date information

  • Keep their access credentials confidential

  • Notify the Company immediately of any unauthorised use of their Account

  • Not share their Account with third parties

5.2 Account types

The App provides different types of account:

  • End User: access to standard configuration features

  • Distributor: access to advanced diagnostic features (requires approval)

​

5.3 Account deletion

The User may delete their Account at any time from the App settings. Deletion entails:

  • Permanent deletion of all data associated with the Account

  • Loss of access to all features that require authentication

  • Impossibility of recovering deleted data

​

6. Acceptable Use

​

6.1 User obligations

The User agrees to:

  • Use the App only for lawful purposes and in accordance with these Terms

  • Use the App only with genuine TAMI Devices

  • Not attempt to access unauthorised parts of the Service

  • Not interfere with the operation of the App or its servers

  • Not use the App for unauthorised commercial purposes

6.2 Prohibited conduct

The following are expressly prohibited:

  • Decompiling, disassembling or reverse engineering the App

  • Modifying, adapting or creating derivative works from the App

  • Removing copyright notices or other proprietary rights notices

  • Using the App to transmit malware or malicious code

  • Attempting to access other users' accounts

  • Using automated systems to access the Service

  • Flashing devices with unofficial firmware versions

 

 

7. Intellectual Property

7.1 Company rights

The App, including but not limited to:

  • Source code and software

  • Graphical interface and design

  • Trademarks, logos and trade names

  • Documentation and content

are the exclusive property of Lighthouse Tech SA or its licensors and are protected by copyright and intellectual property laws.

​

7.2 Licence of use

The Company grants the User a limited, non-exclusive, non-transferable and revocable licence to:

  • Download and install the App on devices owned by the User

  • Use the App for personal, non-commercial purposes

  • Access the App's Content in accordance with these Terms

8. Updates and Changes 

​

8.1 App updates

The Company may release App updates that could:

  • Fix bugs or security issues

  • Add new features

  • Modify or remove existing features

  • Require a device firmware update

​​

It is recommended to always keep the App updated to the latest available version.

​

8.2 Firmware updates

Firmware updates for TAMI Devices:

  • May be required for correct operation with new versions of the App

  • Must be installed by following the instructions provided

  • Must not be interrupted during installation

​​

Warning: Interrupting a firmware update may damage the device. Ensure the device is sufficiently charged before starting an update.

​

9. Disclaimer and limitation of Liability 

​

9.1 Service provided "As Is"

The App and the Service are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including but not limited to:

  • Warranties of merchantability

  • Fitness for a particular purpose

  • Non-infringement of third-party rights

  • Uninterrupted or error-free operation

9.2 Limitation of liability

To the extent permitted by applicable law, the Company shall not be liable for:

  • Indirect, incidental, special or consequential damages

  • Loss of data, profits or business opportunities

  • Damages arising from the use of or inability to use the App

  • Damages caused by viruses or other harmful components

  • Damages arising from unauthorised modifications to the devices

9.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, the limitations apply to the maximum extent permitted by law.

10. Indemnification 

The User agrees to indemnify, defend and hold harmless the Company, its officers, employees and partners from any claim, damage, loss, liability and expense (including legal fees) arising from:

  • The User's breach of these Terms

  • Improper use of the App or the Service

  • Infringement of third-party rights

  • Content or data provided by the User

11. Third-Party Services 

The App uses the following third-party services:

  • Google Firebase: for authentication, data storage and notifications

  • Google Sign-In: for authentication via Google account

​

Use of these services is subject to their respective terms of service and privacy policies.

​

12. Suspension and Termination

​

12.1 Suspension

The Company may suspend access to the Service in the event of:

  • Breach of these Terms

  • Suspicious or fraudulent activity

  • Request from competent authorities

  • System maintenance or updates

12.2 Termination

The Company may terminate the User's access to the Service in the event of:

  • Serious or repeated breach of the Terms

  • Fraudulent use of the Service

  • At the User's request

13. Communications

The User agrees to receive communications from the Company via:

  • Push notifications in the App (if enabled)

  • Email to the registered address

  • Notices in the App interface

​​

The User may manage notification preferences from the App settings.

​

​

14. Governing Law and Jurisdiction

These Terms are governed by Swiss law.

For any dispute arising from the interpretation or performance of these Terms, the parties agree to attempt an amicable resolution. In the absence of agreement, the courts of Morbio Inferiore (registered office of Lighthouse Tech SA), Switzerland, shall have jurisdiction.

For consumers resident in the EU, the mandatory consumer protection provisions of their country of residence shall apply.

15. General Provisions 

​

15.1 Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between the User and the Company regarding the use of the App.

​

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

​

15.3 Waiver

The Company's failure to exercise any right shall not constitute a waiver of that right.

​

15.4 Assignment

The User may not assign their rights or obligations under these Terms without the written consent of the Company.

16. Changes to the Terms

The Company reserves the right to modify these Terms at any time. Changes will take effect from the date of publication in the App.

In the event of material changes:

  • The User will be notified via an in-app notification

  • Continued use of the App after notification constitutes acceptance of the new Terms

  • Users who do not accept the changes may delete their Account
